Is It Appropriate to Use Incentives in Your Estate Plan?

Is it appropriate to include incentives or disincentives in your estate plan? It depends on your goals. If you have minor children and want to ensure they attend college, you might stipulate that they’ll receive certain funds upon completing their degree. You can provide specific instructions to the trustee for managing this. Similarly, if you want to encourage them to start a business, you could require them to submit a business plan to the trustee. On the other hand, if you’re dealing with more challenging situations, like a child with substance abuse problems, you might include provisions that restrict their access to funds until they’ve completed a program and remained sober for a set period. An estate plan can be a powerful tool to help guide your loved ones toward the life you envision for them, whether through incentives or disincentives.
